5. Product Availability

Products are subject to availability.

Adding a product to your basket does not reserve it. An order may be rejected or cancelled if:

• We cannot lawfully supply the product to the destination;

If we cancel an order after payment has been received, we will refund the relevant amount to the original payment method.

6. Order Process

Your order constitutes an offer to purchase the products in your basket.

An automated order-confirmation email acknowledges receipt of the order but does not necessarily mean that the order has been accepted.

The purchase contract is formed when we confirm acceptance, begin processing the order, or dispatch the product, depending on the applicable circumstances and law.

You are responsible for reviewing your order, billing information, delivery information, product selection, quantity, and price before completing checkout.

7. Prices, Taxes, and Charges

Prices are displayed in the currency selected or presented on the website.

The total amount payable, including applicable taxes and delivery charges collected by us, will be displayed before you complete payment.

Depending on the destination and fulfilment arrangement, additional import VAT, customs duties, brokerage charges, or local fees may apply.

Where these charges are not collected at checkout, we will clearly disclose this before purchase whenever required by applicable law.

We will not intentionally impose undisclosed mandatory charges after checkout.

Available payment methods are displayed at checkout.

By submitting payment information, you represent that:

• The transaction is not fraudulent or unlawful.

Payments may be processed by Shopify Payments and other authorised payment-service providers. These providers may conduct fraud prevention, identity, sanctions, and compliance checks.

We do not directly store complete payment-card information where payment processing is handled by an authorised payment provider.

9. Delivery

Delivery estimates, available destinations, shipping charges, and other conditions are governed by our Shipping Policy and the information displayed at checkout.

Unless a different period is agreed with you, we aim to deliver orders within 30 days after the contract is formed.

Delivery dates are estimates unless expressly stated to be guaranteed.

Nothing in these Terms removes your rights where delivery is materially delayed or does not occur within the period required by applicable law.

10. Risk and Ownership

Risk of accidental loss or damage generally passes to the customer when the customer, or a person designated by the customer other than the carrier, takes physical possession of the product.

Where you independently appoint a carrier not offered by us, risk may pass when the product is delivered to that carrier, subject to applicable law.

Legal ownership of the product passes after full payment and delivery, unless applicable law provides otherwise.

11. Returns, Cancellations, and Refunds

Returns, cancellation rights, refunds, faulty products, and statutory guarantees are governed by our Return and Refund Policy.

Nothing in these Terms limits mandatory rights available to consumers under the laws of the United States, the laws of the United Kingdom, the laws of a European Union member state, or another applicable jurisdiction.

12. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions disclosed with the offer.

Unless otherwise stated:

• Codes cannot be exchanged for cash;
• Codes may not be combined;
• Codes may be limited to certain products, customers, regions, or dates;
• Codes may be withdrawn where misuse or fraud is reasonably suspected; and
• A code cannot be applied after an order has been completed.

Promotional conditions do not remove statutory consumer rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, translate, and display submitted content for operating and promoting BVS Shop, subject to applicable privacy and consumer law.

We may moderate or remove content that violates these Terms, but we will not suppress genuine negative reviews solely because they are negative.

References to third-party trademarks remain the property of their respective owners.

We are not responsible for an independent third party’s website or service, except to the extent that applicable law makes us responsible for its acts or omissions.

You must read and follow all product instructions, warnings, age restrictions, compatibility requirements, and safety information.

Products must be used only for their intended purpose.

Do not use a product where doing so would be unsafe, unlawful, or inconsistent with its instructions.

This section does not exclude liability for an unsafe or defective product where liability cannot lawfully be excluded.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the website is provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, or free from every harmful component.

However, nothing in these Terms excludes statutory guarantees or warranties that cannot lawfully be excluded, including rights relating to product quality, conformity, fitness for purpose, safety, and accuracy of description.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:

• Death or personal injury caused by negligence;
• Fraud or fraudulent misrepresentation;

• Violation of mandatory consumer rights.

Subject to those exceptions, Atlas Horizon LLC will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses incurred by a consumer using a product primarily for personal purposes.

Any limitation must be interpreted consistently with the mandatory law of the customer’s country.

21. Indemnification

Where legally permitted, you agree to be responsible for losses reasonably resulting from your unlawful use of the website, fraudulent conduct, infringement of third-party rights, or material violation of these Terms.

This provision does not require a consumer to compensate us for exercising a statutory right or making a legitimate complaint.

22. Force Majeure

We are not responsible for delay caused by events beyond our reasonable control, such as natural disasters, war, civil unrest, government restrictions, carrier disruption, strikes, epidemics, infrastructure failures, or customs emergencies.

We will take reasonable steps to minimise the effects of the event and resume performance.

This section does not remove your right to cancel or receive a refund where applicable law gives you that right because of prolonged non-performance.

Please include your name, order number, description of the issue, and the resolution requested.

We will review complaints fairly and respond within a reasonable period.

You may also contact an applicable consumer-protection authority or use another dispute-resolution mechanism available under the law of your country.

24. Governing Law and Consumer Jurisdiction

These Terms are governed by the laws applicable to Atlas Horizon LLC in its United States state of formation, without excluding applicable federal law.

However, if you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law of your country of habitual residence.

A consumer may bring a claim in any court that has jurisdiction under applicable consumer law. Nothing in these Terms requires a consumer to bring a claim exclusively in the United States where such a requirement would be unlawful or unfair.

25. Severability

If any provision is held to be invalid, unlawful, or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

26. No Waiver

A failure or delay in enforcing a provision does not constitute a permanent waiver of that provision or any other right.

27. Changes to These Terms

We may update these Terms to reflect legal, operational, security, or business changes.

The version applicable to an order is generally the version available when the order is placed, unless a change is required by law or is expressly accepted by the customer.

The latest revision date will appear at the top of this page.
